A scheme to protect Welsh house and place names

DIOGELWN is a new scheme, which is a partnership between Cymdeithas yr Iaith and the people of Wales.

We see Welsh house and place names as communal property and as an integral part of Welsh heritage, which should be protected for the sake of future generations.

The idea at the heart of the scheme is a very simple one, and is relevant to anyone, who lives in Wales and owns a house or land with a Welsh name (even if you do not intend to sell it at the moment).

• If you are intending to sell the house or the land: you can ask your solicitor/conveyancer to include a particular clause in the sale contract and transfer with the aim of preventing the buyers and their successors in title from changing the name of the house or land (or, depending on the circumstances, from giving to a new house any name other than the name of the land or a name which has a connection with the local area) in the future.

• If you do not intend to sell the house or the land at the moment: you can sign a contract with Cymdeithas yr Iaith with the help of your solicitor/conveyancer and ask him/her to complete the contract and to register it with the Land Registry, with the aim of preventing buyers or beneficiaries under your Will and their successors in title from changing the name of the house or land (or, depending on the circumstances, from giving to a new house any name other than the name of the land or a name which has a connection with the local area) in the future.

Our lawyers have prepared clauses and documents, which your solicitor/conveyancer is welcome to use:

• Standard Scheme Clause (Sales) (house either with or without land): for use if you are selling a house (either with or without land), situated in Wales.

• Standard Scheme Document (Self-covenanting) (house either with or without land): for use if you own a house (either with or without land), situated in Wales, and you want to sign a contract with Cymdeithas yr Iaith in relation to that house.

• Standard Scheme Clause (Sales) (undeveloped land): for use if you are selling a piece of undeveloped land, situated in Wales.

• Standard Scheme Document (Self-covenanting) (undeveloped land): for use if you own a piece of undeveloped land, situated in Wales, and you want to sign a contract with Cymdeithas yr Iaith in relation to that land.
